Legal basis

Disclosure of debtor’s information is in accordance with Art. 4 of the Act on Provision of business information and exchange of business data of 9th April 2010 (Journal of Law of 2010, No. 81, item 530), according to which:

“Art. 4. Disclosure of business information to third parties, unspecified at the time of releasing of this information, shall be done solely through the Economic Information Bureau, unless the disclosure is performed for the purpose of selling liabilities through public notice or in case the provisions of law  indicate a different mode of data sharing.”

Furthermore, provisions of the Personal Data Protection Act of 29th August 1997 (Journal of Laws of 2002, No. 101 item 926, as amended) in Art. 23, paragraph 1, point 5 allow for processing of personal data should this be necessary for the fulfilment of legally justified objectives realised by data administrators or recipients, and provided that the processing does not violate the rights and freedom of data recipients. A legally justified objective, referred to in Art. 23, paragraph 1, point 5 is in particular, an assertion of claims arising from business activity (Art. 23, paragraph 4, point 2 of the Personal Data Protection Act).
